Speaker announces Independent Fomena MP’s seat empty

The Speaker of Parliament, Prof Aaron Mike Oquaye in administering on an appeal brought to the house by the New Patriotic Party has announced the seat of Member of Parliament for Fomena, Andrew Amoako Asiamah as empty.

The New Patriotic Party kept in touch with Parliament soliciting initiative from the house to oust the MP after he documented with the Electoral Commission to challenge in the 2020 parliamentary decisions as a free applicant.

As per the Party, Andrew Amoako Asiamah relinquished his enrollment by his activity and that fills in as conceivable grounds to pull out him from the House as per Article 97(1)(g) of the 1992 Constitution.

“For the shirking of uncertainty, Article 97(1)(g) of the Constitution expresses that: An individual from Parliament will clear his seat in Parliament in the event that he leaves the gathering of which he was a part at the hour of his political race to Parliament to join another gathering or tries to stay in Parliament as an autonomous part,” the NPP said in an assertion.

The Speaker on Saturday, November 7, 2020, articulating a decision on the request said that “hosting relinquished his participation of the get-together on whose ticket he was chosen for parliament, the employable language of the constitution is that he will, which is compulsory clear his seat in parliament. Passing by a purposive translation of the current law, consultative activities with respect to the MP are significant. To all expectations and purposes, he is not, at this point an individual from the gathering, he has articulated himself openly as an autonomous and has recorded his papers to go up against the gathering and its up-and-comer as a free applicant on December 7, 2020.”

“On that event this parliament will in any case be working as an official parliament of the republic of Ghana. We will not have a circumstance received openly by any sitting MP when he/she will battle unreservedly against the gathering which the person actually speaks to in parliament but ludicrously remains against the gathering. No purposive translation of law will permit such mocking to win,” the speaker said.

As indicated by the speaker, the lacuna of such a strange circumstance isn’t what was foreseen under the 1992 constitution.

He articulated that: “in light of the current situation, parliament has confirmed that the lead of Hon. Andrew Amoako Asiama adds up to emptying his seat in parliament. Likewise, we carry this to the notification of the Electoral Commission for important move to be made as per the law.”
